Vous n&rsquo;\u00eates alors pas consid\u00e9r\u00e9 comme un tiers et vous n&rsquo;\u00eates jamais couvert pour vos propres dommages. Il est donc important d&rsquo;aborder cette question avec votre courtier en temps opportun (et certainement avant le d\u00e9marrage du chantier) afin de pr\u00e9voir une clause d\u00e9rogatoire dans la police (abonnement ou chantier unique) afin de b\u00e9n\u00e9ficier d\u2019une couverture en bonne et due forme. Cette clause peut alors exceptionnellement vous consid\u00e9rer en tant que tiers pour le projet en question afin d&rsquo;assurer \u00e9galement vos propres dommages. Il n&rsquo;est pas exclu que l&rsquo;assureur assortisse cette clause \u00e0 une exemption plus large et\/ou \u00e0 la souscription d&rsquo;une police TRC. voor klanten ook je eigen woning of kantoor te kunnen ontwerpen en in te staan voor de werfopvolging hiervan.<\/p><p>Vaak wordt deze eigen woning als een klassiek project aangegeven bij de beroepsaansprakelijkheidsverzekeraar wat bij schade helaas \u00a0zeer nadelige gevolgen kan hebben. En daar zit nu net het probleem als je zowel de hoedanigheid hebt van architect <u>en<\/u> bouwheer. Dan word je dus niet beschouwd als een derde en ben je ook nooit verzekerd voor de eigen schade. Daarom is het belangrijk om dit tijdig (zeker voor de opstart van de werf) met jouw makelaar op te nemen om hiervoor een afwijkende clausule in de polis (abonnement of enige werf) te kunnen voorzien. In deze clausule kan je dan voor het project in kwestie uitzonderlijk worden opgenomen als een derde om zo ook de eigen schade te verzekeren. Het is niet uitgesloten dat de verzekeraar dit koppelt aan een hogere vrijstelling en\/of de onderschrijving van een polis ABR. Hierbij denken we bv. aan buren of kopers achteraf. Ook dit dient te worden besproken met jouw makelaar. De oplossing kan bestaan in een eenmalige premievoet op de bouwkost van het project of het in rekening brengen van een nader te bepalen fictief ereloon.
